NPA asked to throw some light on a referral, I’ve received from one of our walk leaders. It relates to a, now damaged, sign close to SO 25152 28619 deterring people from using what seems to be an accessible track at least to SO24777 29134, when it seems to become a private track. People are directed NE to Public ROW code 36/3/4. Our member felt that people were being discouraged from using the Footbridge at SO24863 28882 to access the unmade path to Pen y Gadair.
Additionally, our member reports being prevented from using the path which runs South Easterly from Grwyne Fawr Reservoir to and through the property at Grwyne Fawr, which has been walked by people for decades. But it seems to me to be a private track.
The tarmac road from the junction with the restricted byway is indeed a private road. However the land (including that road ) has been mapped as access land under the CROW Act so the public has a right to walk along it apart from the exception below.
The CROW Act does not confer a right to walk on Land covered by buildings or the curtilage of such land, or on land within 20 metres of a dwelling even though it may be mapped as access land. Unfortunately under the CROW Act it is not possible therefore to use the road get past Grwyne Fawr cottage and onwards to the dam. BBNPA has been in discussion with the owner of the track to try to remedy this issue but it is not proving to be straight forward.
Regarding the signs NPA has written to the owner of fence and asked them to remove any signs that are misleading and designed to deter legitimate visitors.
